WHO IS ELIGIBLE TO RECOVER?

Any person, driver or passenger, that is responsible in any way for the occurrence of the accident.
WHAT COMPENSATION MAY BE PAID?
Generally, most compensation is received from insurance policies covering the person at fault. This compensation acts as a settlement in lieu of litigation. However, when insurance policies alone are not sufficient, the injured party may also recover directly from the person who caused the accident. In order to recover directly from the person at fault, litigation is usually required.
WHAT DOES THE SETTLEMENT COVER?
Generally, the settlement consists of three parts: 1) pain and suffering, 2) medical bills, 3) attorney fees and expenses. Other factors considered include: loss of wages, prescription costs, travel expenses, disability ratings, etc
HOW ARE MEDICAL BILLS PAID?
Health insurance should pay for the majority of medical bills. However, some health insurance policies require reimbursement when the claim is resolved (subrogation). When a client does not have health insurance, up to one-third of the settlement may be set aside for medical expenses.
WHAT ABOUT MEDICAID OR MEDICARE?
If injured in an accident that is someone else's fault, Medicaid / Medicare will pay for most of the medical bills that are incurred. Medicaid / Medicare always requires reimbursement.
FRAUDULENT CLAIMS
If a false claim is deliberately filed, the claim will be denied. Additionally, the claimant will have to repay any money awarded and be subject to prosecution.
